Igor Dodon: I welcome the CCM decision, which was delayed but necessary

The President of the Republic of Moldova Igor Dodon welcomes the decision of the Constitutional Court of the Republic of Moldova (CCM) of August 6, in which it ruled on the role of the President of the Republic of Moldova in the procedure for appointing the candidate for Prime Minister. According to the head of state, although the CCM's decision is a delayed one, it is necessary.

"I welcome this decision. I consider it delayed, but necessary. The president cannot be suspended for five minutes and the powers transferred to the speaker or prime minister, as was the case during Plahotniuc's government. What happened in 2017-2018 was an illegal thing, when the president of the country, by the decision of the CCM, was temporarily suspended from office in order to allow the signing of decrees in his absence. Why delayed? Because the Venice Commission said this in June-July last year. The CCM finally, by its decision, put an end to this issue. It is important that this is clear in this decision last week.

The head of state also spoke about the procedure for submitting the candidacy of the prime minister by the Parliament.

"The CCM said one very important thing - the formalized parliamentary majority can submit a candidacy that the president must accept. According to the Rules of Procedure of the Parliament, the parliamentary majority is announced at the sitting of the Parliament, not the signing of 51 deputies in the cabinet at I don't know who," said Igor Dodon.

According to the head of state, in the current Parliament, the creation of a formalized majority in the sitting of the Parliament without the participation of the Party of Socialists of the Republic of Moldova is practically impossible.

"The CCM also specified that if the president does not accept this candidacy, the constitutional procedure is started, which means that 67 deputies must vote for the suspension of the president, no chance in this Parliament. Even if this happens, a referendum must take place in 30 days, at which for the president’s resignation must sign at least one vote more than the number of people who voted for the president four years ago. That is 836 thousand people, which is also impossible in this situation," Igor Dodon also declared.

TRM.MD recalls that the CCM established by the decision issued on August 6 that, in case the president refuses to nominate the candidate for the position of prime minister submitted by the formalized parliamentary majority, this situation must be solved in the light of art. 89 of the Constitution, which provides for the suspension from office and dismissal of the President of the Republic. According to the CCM Decision, within the meaning of art. 98, para. 1 of the Constitution, the discretionary margin of the President of the Republic of Moldova in the nomination of the candidate for the position of Prime Minister is limited.
