Republic of Moldova, convicted in three cases at the ECHR. The reaction of the Minister of Justice

The Republic of Moldova was again convicted in three cases at the ECHR. All cases refer to the application of inhuman and degrading treatment in detention and to the granting of moral and material damages in a reduced amount, without taking into account the ECHR's practice of granting moral compensations in similar cases, reports Moldova 1.

In the Baban case, the applicant was detained in Lipcani Penitentiary No.2, where he was repeatedly mistreated and humiliated by the guards. He was refused medical attention, but also the request for special food.

In other similar cases, the national courts granted small amounts as moral damage. In the cases of Ciorap and Gavrilita, the Supreme Court awarded moral damages in the amount of 600 euros to the first defendant and 900 euros to the second, compared with 4 thousand euros and 9 thousand euros granted by the ECHR.

"In the new cases from the ECHR, we asked the government to bring criminal proceedings and to collect the damages caused to the state. At the same time, I asked them to take other legal actions that are required. That cannot continue! It is enough!” said the Minister of Justice, Fadei Nagacevschi

TRM.MD recalls that, last week, according to a decision published by the ECHR, the Government was obliged to pay, until May 18, 2020, over 3.5 million euros, in the case of the "S.A. Gemenii" file. Prime Minister Ion Chicu said that the money would be redirected to the ECHR from the judiciary and that he does not intend to pay from the state budget for "some illegal judgments committed by judges".
