Journalists and lawyers request new provisions regarding access to information of public interest

New provisions regarding access to information of public interest. Several NGOs that bring together journalists and lawyers request new provisions regarding access to information of public interest. Their proposals are in a bill that will be sent to MPs within 10 days in order to be submitted as a legislative initiative, reports Mesager.

As a rule, journalists who request information about  the activity of public institutions, the management of public money or the businesses  of some officials,  encounter difficulties. This is because these data would be personal and cannot be made public. This information hardly reaches the general public.

Journalists claim that in recent years most of the time they get their rights in court.

" Public authorities simply, either in ignorance or in bad faith, do not provide the information of public interest and the theme that the journalist is going to disseminate in the public space is already losing importance. Cases can take up to  1 or 2 years”said Tatiana Puiu, a lawyer at the Freedom House Representation in Moldova.

A draft law that would clarify things and make a clear distinction between access to information and the protection of personal data was developed by representatives of the Association for the Protection of Private Life, in cooperation with national and international experts.

" The journalist must know how far he goes in documenting the information, so as not to violate other rights and the right of access to information, of public interest, respectively," said Cornelia Cozonac, director of the Center for Investigative Journalism .

The authors propose that all provisions be introduced in the Law on access to information. According to them, the new amendments to the Law on access to information clearly establish that the processing of personal data of public interest is not an interference with the private life.

"Requests for access to personal data of public interest shall be made under the Law on access to information, and not under the Law on Personal Data Protection.  We come with the proposal to offer journalists free access to all the information systems with personal data of public interest. We propose that the deadline for examining these applications should be no more than ten days from of submission, "said Sergiu Bozianu, president of the Association for the Protection of Private Life.

The bill will be sent to MPs for consideration in Parliament.
