The business community could have a People's Advocate
Parliament could establish the position of People's Advocate for the rights of entrepreneurs. The Committee on Legal Affairs, Appointments and Immunities will propose to Parliament's plenary approval, at first reading, of a draft amendment to that effect to several laws.
According to the draft, the Ombudsman for Entrepreneurship Rights will ensure that public authorities' rights and legitimate interests are respected by public authorities, organizations and enterprises, regardless of ownership and legal form of organization, by non-profit organizations and by individuals with responsibility functions of all levels.
The document also proposes the amendment of several normative acts regulating aspects related to the activity of the People's Advocate for the rights of entrepreneurs - remuneration, public dignitary status, right to notify the Constitutional Court, civil and criminal procedural rights, right to submit proposals to amend the normative framework, etc..
"The establishment of a new position of People's Advocate for the rights of entrepreneurs is meant to assist economic agents in counteracting abuses committed, in particular, by public authorities and institutions and eliminating shortcomings in the regulatory framework. This assistance in the most direct way will lead to the decrease of the existing expenses for the development of the business and, correspondingly, the increase of the incomes,” reads the informative note of the project.
The People's Advocate for Entrepreneurs' Rights will be appointed by Parliament and will act autonomously vis-à-vis the People's Advocate and the People's Advocate for Children's Rights. The Parliament, within one month from the date of entry into force of this law, will organize a competition for the selection of candidates for the position of People's Advocate for the rights of entrepreneurs.
The draft has been previously approved by the Government and is to be debated in Parliament.
In this context, the representatives of the National Confederation of Trade Unions of Moldova (CNSM) issued a statement claiming that this initiative is in total dissonance with the recommendations of international human rights organizations and contributes to the multiplication of institutions financed from the public budget. Consequently, CNSM requested the withdrawal of the draft law proposing the establishment of the People's Advocate for Entrepreneurs' Rights.
