ECHR rejected Elena Udrea’s request to suspend her European arrest warrant. Udrea, expected in the country

The European Court of Human Rights on Wednesday refused to suspend the European arrest warrant on behalf of Elena Udrea. The former Minister of Development is due to arrive in the country on Thursday, after a Bulgarian court rejected his request not to be handed over to the Romanian authorities, where he has to serve a six-year prison sentence for corruption.

Elena Udrea was definitively convicted of corruption in June 2018, when she was in Costa Rica. His appeal for annulment was rejected on April 7, and another extraordinary appeal against the sentence is currently underway, according to Agerpres.

At the same time, the Romanian authorities issued an arrest warrant on behalf of the former head of the Ministry of Tourism and Regional Development (2009-2012), according to an ECHR statement. Udrea was arrested in Bulgaria the same day while trying to reach Greece, the Strasbourg court also held.

The European mandate has been confirmed by the Bulgarian judiciary, and as a result Udrea notified the ECHR on Tuesday, requesting the urgent suspension of the execution of the European mandate by the Bulgarian authorities. She also asked not to be extradited to Romania.

Udrea invoked in support of his request several articles from the European Convention on Human Rights, showing in particular that it is going to be closed in inappropriate conditions, due to the overcrowding of the penitentiaries in Romania. She also said she received death threats while in custody. She also claimed that she had been convicted by an illegally constituted court, which was not independent and impartial, the ECHR also noted.

Her arguments did not convince European magistrates, who “decided to reject the application of the interim measure,” the ECHR said, without giving reasons for its decision.
