CRJM: Number of Moldovans’ complaints with the ECHR is 3 times higher than the European average
The number of Moldovans’ complaints with the ECHR is 3 times higher than the European average. This is the finding of the Legal Resources Center in Moldova that analyzed the Court's work for last year. According to lawyers, the amount paid by the Government to citizens increased considerably. The Supreme Court of Justice has not yet commented on this report, Mesager reports.
According to lawyers, the situation regarding respect for citizens' rights and freedoms in the transnistrian region is not improving. Moreover, these topics are not discussed either in the "5 + 2" negotiation format.
"We ask the authorities every time to take an active attitude. The "5 + 2" format of negotiations addressed some social, economic rights. Social-political rights are left behind, they are neither discussed nor put on the agenda of this format", said Promo-LEX lawyer Natalia Hriplivii.
"On December 31, 2018, 1204 complaints field by Moldovans were still awaiting examination, 93%, that is, more than a thousand complaints might win.
We have had 387 decisions for 21 years and soon we will have more than a thousand judgments, that is, double or triple compared to now", says Legal Advisor of CRJM Daniela Goinic.
In 2018, the European Court of Human Rights delivered 33 judgments. In only six cases the ECtHR found that the Republic of Moldova did not violate European rights. The vast majority of them refer to the Transnistrian region involving the conviction of the Russian Federation.
Last year, the Chisinau government was obliged to pay over 234,000 euros to citizens who filed complaints with the European Court for Human Rights, compared to 95,000 in 2017.
The most common are violations of inhuman conditions of detention, ill-treatment, and violations of the right to liberty and security. In the last 20 years, the ECHR ruled 380 judgments involving Moldova, for which damages amounting to almost 16 million euros were paid. The Supreme Court has not yet commented on the report of the Legal Resources Center in Moldova.
