Sergiu Litvinenco: The Republic of Moldova could have a general prosecutor from abroad

By the end of this year, we could have a general prosecutor, selected through a competition organized by the current composition of the Superior Council of Prosecutors. This was announced by the Minister of Justice, Sergiu Litvinenco, in the context in which the mandate of the interim General Prosecutor, Dumitru Robu, expires in October. Sergiu Litivinenco does not rule out that the next general prosecutor could come from abroad, given that the law allows the future head of the Prosecutor's Office to have professional experience in the country or abroad, IPN reports.

The Minister of Justice says that now a bill is being worked out that would come with the solution for filling the position of general prosecutor after the mandate of the interim prosecutor, Dumitru Robu, expires. Sergiu Litvinenco says that in the conditions in which there is no finality on the “Stoianoglo” case, either the extension of Dumitru Robu's interim will be considered, or the appointment of a general prosecutor for a determined period.

"The project was developed based on the conclusions of the Venice Commission in December 2021, and we do nothing but bring the legislation in line with that opinion of the Venice Commission. It is not excluded that this problem will be addressed and the solution will be given in the final law. There would be several options, you can extend the interim, if we extrapolate to other top positions , you can appoint a General Prosecutor who would have a term of 7 years, but who could end his term if the former Attorney General returns to office. In the case of civil servants, that's right. If someone is suspended, a competition is held for that position ", said Sergiu Litvinenco during the show "Cutia Neagră" on TV8.

According to the minister, if the option of organizing a new contest is chosen, the CSP will start the pre-selection procedure, and the president Maia Sandu will be the one who will appoint the new general prosecutor.

"When the Council decides to initiate the contest, a deadline is given for all those who meet the criteria, a contest is organized, then a decision is reached which is sent to the president for confirmation or refutation. The appointment of a prosecutor general of the current composition of the CSP is possible. We could have a general prosecutor until the winter. The conditions for the position of Chief Anticorruption Prosecutor are also valid for the position of General Prosecutor. The law provides for the possibility of including in the position of general prosecutor the persons who have appropriate experience both in the country and abroad ", the Minister of Justice also said.

Dumitru Robu took over the interim position of Attorney General on October 6, 2021. The appointment decree was signed by President Maia Sandu, after Robu's candidacy was proposed to the head of state by the Superior Council of Prosecutors.
